Jazz Café Terms of Use

Provider: STS WORKS (“we”, “us”)

1. Scope and acceptance

These terms apply specifically to the Jazz Café application and related website (the “Service”). By installing, accessing, purchasing, or using the Service, you agree to these terms and Apple’s applicable App Store terms.

2. License for personal and in-store playback

We grant you a limited, non-exclusive, non-transferable, revocable license to play audio supplied through the Jazz Café app:

for personal listening; and
as background music inside a physical customer or workplace location that you operate, including a café, restaurant, bar, salon, retail shop, studio, clinic, office, waiting room, or similar small commercial space.

This in-store permission applies to both the free service and Store Plus. Store Plus adds app features such as an ad-free screen, background playback, and broader track access; it is not required merely to obtain the in-store permission above.

The permission covers ordinary ambient playback at one location from one active device per account or App Store entitlement at a time. It applies only to audio delivered by Jazz Café and only while played through the Service.

3. Uses not permitted

Unless we separately agree in writing, you may not:

extract, copy, download outside the app, record, redistribute, resell, sublicense, or make the audio available as standalone files;
synchronize the audio with video, advertising, podcasts, games, livestreams, broadcasts, social posts, or other media;
use the audio as the principal attraction at a ticketed event, performance, DJ set, or paid online stream;
modify or remove rights, attribution, access-control, or technical-protection information; or
use the Service in an unlawful manner or to infringe another party’s rights.

4. Store Plus and billing

The public name of our paid plan is Store Plus. Existing purchases made under the previous paid-plan name continue with the same entitlement. Available features, prices, billing periods, free trials, and renewal terms are shown in the App Store purchase screen and may vary by country. Billing, cancellation, and refunds are handled through your Apple ID and Apple’s policies.

5. Music rights and local requirements

We grant the permission in Section 2 for audio that Jazz Café supplies for this Service. That permission does not cover music or other content you add from elsewhere. You remain responsible for complying with laws and venue-specific requirements that apply to your location, equipment, and manner of use. If a local authority or rights organization requests information, contact us before making representations on our behalf.

6. Availability and changes

Tracks, scenes, features, free rotations, and Store Plus benefits may change as the Service develops. We may suspend access for maintenance, security, legal compliance, abuse, or events outside our reasonable control. We do not promise uninterrupted playback, so businesses should keep an operational fallback for critical use.

7. Privacy and analytics

Jazz Café does not require an account. We use limited device and product analytics, including playback milestones, Store Mode choices, reliability events, purchase status, and review-prompt eligibility, to operate and improve the Service. See our Privacy Policy for details.

8. Intellectual property

The Service, including its software, artwork, interface, branding, and supplied audio, is owned by or licensed to us. Except for the limited permissions in these terms, no ownership or other rights transfer to you.

9. Disclaimer and limitation of liability

The Service is provided “as is” to the extent permitted by law. We are not liable for indirect, incidental, special, consequential, or lost-business damages arising from use or inability to use the Service. Nothing in these terms excludes rights or liabilities that cannot legally be excluded.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for a material or repeated breach. The in-store license ends when your right to use the Service ends. Sections that by their nature should survive will continue to apply.

11. Changes to these terms

We may update these terms when the Service, licensing model, or law changes. Material changes will be posted here with a new effective date. Continued use after the effective date constitutes acceptance where permitted by law.

12. Governing law and contact

These terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance, unless mandatory consumer law provides otherwise.
